On August 6, 2010, a putative class action was filed in the Supreme Court of British Columbia, which alleges that the British Columbia Lottery Corporation (BCLC) improperly denied jackpots prizes to persons enrolled in the Voluntary Self-Exclusion Program.
This action seeks a Court order requiring that the BCLC pay to persons enrolled in the Voluntary Self-Exclusion Program the value of any jackpot prizes won by those persons. In the alternative, the action seeks a Court order requiring that the BCLC return the value of any wagers made by persons enrolled in the Voluntary Self-Exclusion Program.
Why is a class action being brought against the British Columbia Lottery Corporation?
In British Columbia, the BCLC manages casino gaming. In performing this management role, the BCLC receives monies paid by individuals to play games of chance at B.C. casinos and in turn pays amounts won by individuals playing games of chance. Where individuals win large jackpot prizes, individuals are required to produce identification in order to claim such prizes.
However, for players who have enrolled in the Voluntary Self-Exclusion Program and win large jackpot prizes, the BCLC identifies these individuals and denies them the right to collect their jackpots. This putative class action alleges that this denial is improper since the BCLC makes little or no effort to prevent these individuals from playing games of chance while still retaining the wagers of these individuals.
For a more detailed understanding of the allegations of the putative class action, please see the Notice of Civil Claim above.
How can I become a class member?
If the action is certified as a class action, then all British Columbia residents that were denied a jackpot prize as a result of their enrollment in the Voluntary Self-Exclusion Program will be automatically included as class members.
